# Supreme Court Says Seat Belts Are Life-Saving Shields, Calls for Strict Enforcement of Existing Rules

New Delhi: The Supreme Court has said that existing laws on wearing seat belts in vehicles are adequate and that their strict enforcement is the responsibility of law enforcement agencies. A bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohan observed that wearing a seat belt is not merely an official formality or a ceremonial requirement, but a life-saving shield.

The bench said law enforcement agencies must ensure strict compliance with the existing rules. Under Rule 138(3) of the Central Motor Vehicles Rules, 1989, the driver and front-seat passenger, as well as passengers in rear seats facing forward, are required to wear seat belts while the vehicle is in motion. Officials must strictly monitor whether citizens are complying with the requirement.

The Supreme Court was considering a public interest litigation seeking strict implementation of orders making seat belts mandatory during vehicle travel. The petitioner’s lawyer argued before the court that a significant number of deaths and injuries caused by road accidents across the country could be prevented through the use of seat belts.

The court, however, pointed out that the existing laws are clear and that the issue lies in their proper implementation.

The death of former Tata Sons chairman Cyrus Mistry in a car accident in September 2022 had triggered widespread discussion on road safety and rear-seat seat belt use across the country. He was travelling in the rear seat without wearing a seat belt, and the incident became a major turning point in road safety awareness.

According to the figures cited, India has only about one per cent of the world’s total cars but accounts for approximately 11 per cent of global road accident deaths. A significant share of these deaths is attributed to people not wearing seat belts inside cars.

Under the Motor Vehicles Act, driving or travelling in a vehicle without wearing a seat belt is an offence under Section 194B. The law provides for a fine of up to Rs 1,000 for the violation.

The Supreme Court’s observations underline the need for enforcement of the existing seat belt rules rather than introducing new legal provisions, with authorities expected to ensure that mandatory seat belt requirements are followed by vehicle occupants.
