New Delhi: The Supreme Court has held that the deity alone is the owner of land purchased with money collected in the name of God and clarified that the responsibility for managing such land would rest with the Devaswom Board. The court made the observation while dismissing a Special Leave Petition filed by the Ernakulam Temple Welfare Committee in a dispute over the ownership and management of the Ernakulathappan Ground.

The Supreme Court dismissed the committee’s appeal against the Kerala High Court order stating that control of the Ernakulathappan Ground should remain exclusively with the Cochin Devaswom Board.

> The temple advisory committee had argued that it also had a share in the ownership of the land purchased with money collected as part of the campaign titled “One Foot of Land for Ernakulathappan.” However, the High Court had held that a private committee functioning as the temple’s advisory committee could not claim personal ownership over property purchased using money collected in the name of the deity. The Supreme Court upheld this position.

The petition was dismissed by a bench comprising Justices Satish Chandra Sharma and N.K. Singh.Senior advocates V. Giri and K. Parameshwar, along with advocate Amit Krishnan, appeared for the temple advisory committee. Senior advocate P.N. Ravindran and advocate P.S. Sudheer appeared for the Cochin Devaswom Board.

The Supreme Court’s order thus upheld the High Court’s position concerning the ownership and management of the Ernakulathappan Ground, with the management responsibility remaining with the Cochin Devaswom Board.
