#  Supreme Court Tightens Rules on Re-Arrest After Illegal Detention

**New Delhi:** The Supreme Court has imposed restrictions on the government’s power to repeatedly arrest individuals, ruling that a magistrate’s permission is required before a person released following an unlawful arrest can be arrested again. A bench comprising Justices Ujjal Bhuyan and Atul S. Chandurkar issued the direction while expanding the scope of Article 22 of the Constitution, which safeguards citizens against arbitrary arrest and detention.

The court observed that even when a person is accused of involvement in a serious crime, the personal liberty and right to life guaranteed by the Constitution cannot be violated. The ruling also laid down specific requirements concerning the communication of the grounds of arrest.

According to the court’s directions, police must provide the grounds for arrest in writing and in a language that the accused can understand. If a person is arrested without complying with this requirement and is subsequently released after the arrest is found to be unlawful, the police cannot arrest the person again without obtaining permission from a magistrate.

Any application seeking custody must include the reasons for the arrest as well as details of the approval obtained from the competent superior authority. If these requirements are not fulfilled, departmental action should be initiated against the concerned officer and the investigation should be handed over to another officer.

The court issued these directions while quashing the detention and arrest of an Akali Dal leader.

The court further held that failure to provide the grounds of arrest would render the arrest unlawful even if a charge sheet is subsequently filed. The person would therefore be entitled to be released from unconstitutional detention.

When seeking custody, the investigating authorities must also explain why the grounds for arrest were not provided in writing at the time of the initial arrest. The accused must be informed of this explanation before such a custody application can be submitted.The magistrate must take a decision on the application within one week, according to the directions issued by the Supreme Court.
