# Supreme Court to Examine Sohrabuddin Sheikh Encounter Case; Amit Shah’s Discharge Will Not Be Reopened

**New Delhi:** The Supreme Court has raised concerns over 92 prosecution witnesses turning hostile during the trial in the Sohrabuddin Sheikh alleged fake encounter case and said the issue of whether the trial was fair and impartial needs to be examined. A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana said it would examine the statements of some witnesses. However, the court made it clear that the discharge of Union Home Minister Amit Shah from the case would not be reopened.

The bench issued notices to the respondents in a petition filed by Sohrabuddin’s brother Rubabuddin Shaikh challenging the Bombay High Court judgment that acquitted 22 accused, including police personnel from Gujarat, Rajasthan and Andhra Pradesh. The Supreme Court is examining the challenge to the acquittal, while keeping Amit Shah’s earlier discharge outside the scope of the proceedings.

The case relates to the deaths of Sohrabuddin Sheikh, his wife Kausar Bi and his associate Tulsiram Prajapati in 2005 and 2006. According to the prosecution case, Sohrabuddin Sheikh, Kausar Bi and Prajapati were allegedly taken into custody by police personnel while travelling by bus from Hyderabad to Maharashtra in 2005. Sohrabuddin was subsequently killed in an alleged encounter near Ahmedabad, followed days later by the alleged killing of Kausar Bi. Prajapati, who was described as a witness to the incident, was also killed in an encounter a year later.

During the trial, 92 of the 210 witnesses examined by the prosecution turned hostile. The special CBI court in 2018 acquitted all the accused, observing that the prosecution had failed to establish the alleged conspiracy. The acquittal was subsequently challenged before the Bombay High Court.

The Bombay High Court dismissed the appeal and upheld the acquittal of all 22 accused. The High Court held that the prosecution had failed to establish its case beyond reasonable doubt, including the alleged abduction and conspiracy.

The Supreme Court has now agreed to examine the challenge to that acquittal. The bench has specifically expressed concern over the large number of witnesses who changed their position during the trial and indicated that statements of selected witnesses would be examined to assess the circumstances surrounding the acquittal.At the same time, the court has made clear that Amit Shah’s discharge from the case, which had already attained finality, will not be reconsidered in the present proceedings.
